CCP Parking Agreement

The Customer and CITY CENTER PARKING, or affiliates (CCP) agree as follows with respect to Customer's passenger vehicle parked our location:

1) Parking space is available only during the hours of operation at the location.

2) Customer shall have a revocable right to park his vehicle at the above location, and no bailment is created. Parking shall be granted on a non-reserved stall basis. If desired, CCP shall have the right to specify the parking space to be used. CCP does not guarantee that parking space will be available at all times for use by customer.

3) CUSTOMER ASSUMES THE RISK OF ANY LOSS OR DAMAGE TO THE VEHICLE OR PERSONAL PROPERTY LEFT THEREIN INCLUDING BUT NOT LIMITED TO DAMAGE CAUSED BY FIRE, THEFT, ACTS OF GOD, ACTS OF ANY THIRD PARTIES OR ANY OTHER CAUSES. IF A VEHICLE IS DAMAGED WHILE PARKED AT THE ABOVE LOCATION THROUGH THE FAULT OF CCP, CCP'S LIABILITY SHALL NOT EXCEED THE REASONABLE COST OF REPAIRING THE VEHICLE. IN NO EVENT WILL CCP BE LIABLE FOR CUSTOMER'S CONSEQUENTIAL DAMAGES, LOSS OF PROFITS OR LOSS OF USE OF THE VEHICLE.

4) Customer shall indemnify, defend and hold CCP harmless from damages or injuries caused by faulty brakes or any other defect in the vehicle, or by the failure of customer to properly set a vehicle's brake.

5) Customer agrees to pay, in advance, CCP's prevailing monthly charge for parking space and services provided by CCP. Payment is due in full on the first day of each calendar month for that month's parking. Upon not less than ten days' notice, CCP shall have the right to change the amount of the prevailing monthly charge for the following month. No deductions or allowances from the monthly charges will be made for days Customer does not use the parking facilities. If Customer fails to pay the current monthly charge in full by the 10th day of the month, Customer may be charged a late fee equal to five percent of that part of any monthly payment which was not paid when due. Late fees are due no later than the first of the month following the month in which the fees are charged. In addition, any account not paid in full by the 15th day of the month may be charged a delinquent account charge of one and one-half percent per month (18% per annum) on the overdue balance, or the maximum rate allowed by law. whichever is less, from the date payment is due until the date the account is paid in full.

6) The current monthly parking identification tag (one tag per space rented) supplied by CCP must be displayed in view on the vehicle at all times while on the parking location. Prevailing daily parking rate may be charged when the tag is not in view on the vehicle, and Customer may also be subject to a citation under city ordinance.

7) This agreement is automatically renewed at the end of each month unless either party gives the other written notice of intent to terminate. Customer must give CCP at least ten days notice before the end of the monthly rental period. Customer is always obligated to pay the entirety of the current month's parking and any past due amounts owed.

8) Customer agrees to be bound by such rules and regulations as CCP may, from time to time, post at the parking location.

9) If Customer fails to comply with any of the terms or conditions of this agreement, CCP shall have the right to immediately terminate this agreement without prior notice to Customer, and CCP will have available to it all other remedies available at law or in equity.

10) Lot managers or attendants are not authorized to make or allow any exceptions to this agreement or to regulations posted by CCP, and CCP will not be bound by any agreement between Customer and a lot manager or attendant or other CCP personnel unless provided in writing by CCP management.

11) When parking at any CCP facility where an attendant parks Customer's vehicle, Customer must give the vehicle's key directly to the attendant, and Customer will bear any and all risk of loss or damage if Customer fails to do so. If the keys entrusted to CCP for purposes of parking a vehicle are lost by CCP. CCP's liability will not exceed the reasonable cost of replacing the ignition key. In no event will CCP be liable for consequential damages, lock exchanges, loss of profits or loss of use of the vehicle as a result of losing the keys. If Customer provides the attendant with and the attendant accepts a duplicate set of keys, this arrangement is made solely for Customer's convenience, and CCP will have no liability whatsoever for any losses, costs, or expenses Customer may incur of any nature whatsoever which result from or relate to any such keys or the vehicle being lost. damaged, or stolen. CCP's employees are not authorized to leave keys in Customers' vehicles after closing and leaving the lot. CCP shall have no responsibility for theft or other loss caused by an employee honoring Customers' request to do so.

12) If Customer's parking facility utilizes an access control system, Customer may be charged the daily rate if Customer fails to utilize their access card.

13) Under no circumstances shall CCP be responsible for consequential damages.
